الأطراف

هذه الشروط اتفاقية بين شركة الخدمة الذهبية للاستشارات الحاسوبية (العلامة التجارية «نكسارا»)، سجل تجاري 83800، رقم ضريبي 178201189، عمّان — الأردن («نكسارا»، «نحن»)، وبين الجهة التي تنشئ حساباً على المنصة («التاجر»، «أنت»). بإنشاء الحساب أو استخدام الخدمة فأنت توافق على هذه الشروط وعلى سياسة الخصوصية وسياسة الاستخدام المقبول وسياسة الاسترجاع.

Parties

These Terms are an agreement between الخدمة الذهبية للاستشارات الحاسوبية (trading as “Nexara”), commercial registration 83800, tax number 178201189, Amman, Jordan (“Nexara”, “we”), and the business that creates an account on the platform (“Merchant”, “you”). By creating an account or using the service you accept these Terms, the Privacy Policy, the Acceptable Use Policy and the Refund Policy.

الخدمة

نكسارا منصة مستضافة تمنحك موقع طلبات باسمك (كتالوج/منيو، سلة، دفع عند الاستلام أو استلام من المحل، تحقق برقم الهاتف)، ولوحة تحكم لإدارة الطلبات، مع وحدات إضافية مدفوعة حسب الخطة (نطاق خاص، طباعة المطبخ، QR للطاولات، مزوّدي التوصيل، مركز الاتصال، سير العمل، التحليلات). حدود كل خطة منشورة في صفحة الأسعار وهي جزء من هذه الشروط.

The service

Nexara is a hosted platform that gives you an ordering website under your name (catalog or menu, cart, cash-on-delivery or pickup checkout, phone verification) and a dashboard to manage orders, with additional paid modules depending on your plan (own domain, kitchen printing, QR dine-in, delivery providers, call center, workflows, analytics). Plan limits are published on the pricing page and form part of these Terms.

الأهلية والحساب

يجب أن يكون عمرك 18 سنة فأكثر وأن تملك صلاحية إلزام المنشأة التي تسجّل باسمها. رقم الهاتف المستخدم في التسجيل هو هوية الحساب، وأنت مسؤول عن سرية رموز الدخول وعن كل ما يتم عبر حسابك. لا يُشترط سجل تجاري لإنشاء الحساب، لكنك مسؤول عن استيفاء أي تراخيص يتطلبها نشاطك.

Eligibility and account

You must be 18 or older and authorised to bind the business you register. The phone number used at signup is the account identity; you are responsible for keeping login codes confidential and for everything done through your account. A commercial registration is not required to create an account, but you are responsible for any licences your activity requires.

الفترة التجريبية والخطة المجانية

يحصل كل حساب جديد على ميزات خطة «النمو» مجاناً لمدة 14 يوماً دون بطاقة ودون أي خصم تلقائي. عند انتهاء الفترة ينتقل الحساب تلقائياً إلى الخطة المجانية بحدودها المنشورة. لا نوقف المتجر ولا نحذف بياناتك بسبب انتهاء الفترة التجريبية.

Trial and Free plan

Every new account receives Growth-plan features free for 14 days, with no card and no automatic charge. When the trial ends the account moves automatically to the Free plan with its published limits. We do not suspend your store or delete your data because a trial ended.

الرسوم

أسعار الخطط بالدينار الأردني كما هي منشورة في صفحة الأسعار. السعر نهائي — لا رسوم إضافية ولا نسبة على الطلبات ولا رسوم تفعيل. الاشتراك شهري أو ربع سنوي أو سنوي بحسب ما تختاره، ولا يوجد تجديد تلقائي. يجوز لنا تعديل الأسعار بإشعار مسبق لا يقل عن 30 يوماً، ولا يسري أي تعديل على فترة مدفوعة مسبقاً أو على تثبيت سعر مُنح لك كتابياً.

Fees

Plan prices are in Jordanian dinars as published on the pricing page. The price is final — no added fees, no per-order percentage, no activation fee. Subscriptions are monthly, quarterly or annual as you choose, and nothing auto-renews. We may change prices with at least 30 days’ notice; no change applies to a period already paid or to a price lock granted to you in writing.

الدفع عبر كليك

يتم الدفع بتحويل كليك (CliQ) إلى الاسم المستعار الظاهر في شاشة الدفع، مع كتابة الرمز المرجعي الخاص بمتجرك في خانة سبب التحويل. بعد تأكيد وصول الدفعة نفعّل الخطة ونرسل لك إيصالاً إلكترونياً. الإيصال وثيقة استلام وليس فاتورة ضريبية.

Payment by CliQ

Payment is made by CliQ transfer to the alias shown on the payment screen, with your store’s reference code in the payment-reason field. Once the payment is confirmed we activate the plan and send you an electronic receipt. The receipt is a proof of payment, not a tax invoice.

التأخر في الدفع

إذا انتهت فترة مدفوعة دون دفعة جديدة تُمنح مهلة 7 أيام تبقى فيها ميزات الخطة فعّالة. بعد المهلة تُعلَّق الميزات المدفوعة فقط ويستمر المتجر على الخطة المجانية. لا نحذف متجرك أو بياناتك بسبب عدم الدفع، ويمكنك استعادة خطتك في أي وقت بسداد الدفعة.

Late payment

If a paid period ends without a new payment, a 7-day grace period follows during which plan features stay active. After the grace period only the paid features are suspended and the store continues on the Free plan. We never delete your store or data for non-payment; you can restore your plan at any time by paying.

مسؤوليات التاجر

أنت المسؤول عن محتوى متجرك: المنتجات وأسعارها وصورها ووصفها، وعن تنفيذ الطلبات، وعن التعامل مع زبائنك وشكاواهم ومرتجعاتهم، وعن الالتزام بالقوانين السارية وبسياسة الاستخدام المقبول. نكسارا ليست طرفاً في العقد بينك وبين زبائنك.

Merchant responsibilities

You are responsible for your store’s content — products, prices, images and descriptions — for fulfilling orders, for your customers, their complaints and returns, and for complying with applicable law and the Acceptable Use Policy. Nexara is not a party to the contract between you and your customers.

الملكية الفكرية

المنصة وبرمجياتها وتصاميمها وعلاماتها ملك لنكسارا أو لمرخّصيها. محتواك (أسماء المنتجات، الصور، الشعار، بيانات الزبائن) يبقى ملكك، وتمنحنا ترخيصاً محدوداً لاستضافته وعرضه ومعالجته لغرض تقديم الخدمة فقط.

Intellectual property

The platform, its software, designs and marks belong to Nexara or its licensors. Your content (product names, images, logo, customer data) remains yours; you grant us a limited licence to host, display and process it solely to provide the service.

أدوار البيانات

بالنسبة لبيانات زبائنك (الاسم، الهاتف، العنوان، الطلبات) أنت المتحكم بالبيانات ونكسارا معالج يعمل وفق تعليماتك ووفق سياسة الخصوصية. بالنسبة لبيانات حسابك أنت نكسارا هي المتحكم. التفاصيل في سياسة الخصوصية.

Data roles

For your customers’ data (name, phone, address, orders) you are the controller and Nexara is a processor acting on your instructions and under the Privacy Policy. For your own account data Nexara is the controller. Details are in the Privacy Policy.

القيود

لا يجوز إجراء هندسة عكسية للمنصة أو نسخها أو محاولة الوصول إلى شيفرتها المصدرية، ولا نشر اختبارات أداء أو مقارنات مرجعية للمنصة دون إذن كتابي، ولا إعادة بيع الخدمة أو تأجيرها، ولا الالتفاف على حدود الخطة أو آليات الأمان، ولا استخدام الخدمة بما يخالف سياسة الاستخدام المقبول.

Restrictions

You may not reverse engineer or copy the platform or attempt to access its source code, publish benchmarks or comparative performance tests of the platform without written consent, resell or rent the service, circumvent plan limits or security measures, or use the service contrary to the Acceptable Use Policy.

التوافر والدعم

نبذل جهداً معقولاً لإبقاء الخدمة متاحة على مدار الساعة، وقد تحدث فترات صيانة أو انقطاع. الدعم عبر واتساب لجميع الخطط، مع أولوية للخطط الأعلى كما هو موضح في صفحة الأسعار. لا تتضمن الخطة المجانية أي التزام بمستوى خدمة.

Availability and support

We make reasonable efforts to keep the service available around the clock; maintenance windows and outages may occur. Support is provided over WhatsApp on all plans, with priority on higher plans as described on the pricing page. The Free plan carries no service-level commitment.

المسؤولية

إلى الحد الذي يسمح به القانون، تقتصر مسؤولية نكسارا الإجمالية الناشئة عن هذه الشروط أو عن الخدمة على مجموع الرسوم التي دفعتها لنا خلال الأشهر الثلاثة السابقة للمطالبة، ولا نتحمل أي أضرار غير مباشرة أو تبعية أو خسارة أرباح. تُقدَّم الخدمة «كما هي» فيما يخص الخطة المجانية.

Liability

To the extent permitted by law, Nexara’s total liability arising from these Terms or the service is limited to the fees you paid us in the three months preceding the claim, and we are not liable for indirect or consequential damages or lost profits. The Free plan is provided “as is”.

الإنهاء والتصدير والحذف

يمكنك إلغاء الاشتراك في أي وقت؛ لا يوجد تجديد تلقائي، وينتقل المتجر إلى الخطة المجانية. يمكنك طلب حذف الحساب في أي وقت. بعد الإنهاء تبقى بياناتك متاحة للتصدير بصيغة CSV لمدة 30 يوماً، ثم تُحذف خلال 90 يوماً على الأكثر، باستثناء ما يلزم الاحتفاظ به قانوناً. يجوز لنا إنهاء الحساب عند مخالفة جسيمة لسياسة الاستخدام المقبول بعد إشعارك حيثما أمكن.

Termination, export and deletion

You can cancel at any time; nothing auto-renews and the store moves to the Free plan. You can request account deletion at any time. After termination your data remains available for CSV export for 30 days and is then deleted within at most 90 days, except what we must retain by law. We may terminate an account for a serious breach of the Acceptable Use Policy, with notice where possible.

القانون الحاكم والقبول الإلكتروني

تخضع هذه الشروط لقوانين المملكة الأردنية الهاشمية، وتختص محاكم عمّان بأي نزاع ينشأ عنها. يُعدّ قبولك لهذه الشروط إلكترونياً (بالنقر على زر الموافقة عند التسجيل) قبولاً صحيحاً وملزماً وفق قانون المعاملات الإلكترونية رقم 15 لسنة 2015، ونحتفظ بسجل القبول (معرّف الحساب، الوقت، عنوان IP، نسخة الشروط).

Governing law and electronic acceptance

These Terms are governed by the laws of the Hashemite Kingdom of Jordan, and the courts of Amman have jurisdiction over any dispute. Your electronic acceptance (clicking the consent button at signup) is valid and binding under the Electronic Transactions Law No. 15 of 2015; we keep a record of acceptance (account id, timestamp, IP address, Terms version).

تعديل الشروط

قد نحدّث هذه الشروط؛ نشعرك بالتعديلات الجوهرية عبر لوحة التحكم أو واتساب قبل 30 يوماً على الأقل من سريانها. استمرارك في استخدام الخدمة بعد السريان يعني الموافقة. الإصدار الحالي: 2026-08-22.

Changes to these Terms

We may update these Terms; material changes are announced through the dashboard or WhatsApp at least 30 days before they take effect. Continued use after that date means acceptance. Current version: 2026-08-22.
